Terms of Service

These Terms of Service ("Terms") govern your access to and use of the MENCAVE platform, website, and services (collectively, the "Service") operated by MENCAVE ("MENCAVE," "we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

To use the Service, you represent and warrant that:

• You are at least 18 years old;
• You have the legal capacity to enter into a binding agreement;
• You will provide accurate, complete, and current registration information.

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You may not:

• Create more than one account;
• Transfer or sell your account;
• Impersonate another individual or entity.

You retain ownership of any content you submit, post, or display on the Service ("User Content").

By submitting User Content, you grant MENCAVE a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, host, reproduce, modify, adapt, publish, distribute, and display such content for the purpose of operating, improving, and promoting the Service.

You represent and warrant that:

• You own or have the necessary rights to your User Content;
• Your content does not violate any laws or third-party rights.

You agree not to use the Service to:

• Harass, abuse, threaten, or harm others;
• Promote violence, hatred, or discrimination;
• Share illegal, sexually exploitative, or misleading content;
• Distribute spam, scams, or unauthorized advertising;
• Violate privacy rights or disclose personal information without consent;
• Use bots, scrapers, or automated systems without authorization;
• Interfere with or disrupt the integrity or performance of the Service.

MENCAVE reserves the right to investigate violations and take appropriate action, including content removal, account suspension, or termination, at its sole discretion, with or without notice.

The Service may include private groups ("Circles"). Access is subject to approval by Circle administrators.

Content shared within Circles is intended to remain private among members. You agree not to copy, reproduce, or distribute Circle content outside of the Circle without explicit consent from the content owner.

MENCAVE does not guarantee the confidentiality of content shared within Circles and is not responsible for unauthorized disclosures by users.

MENCAVE may, but is not obligated to:

• Monitor content or user activity;
• Investigate reported violations;
• Remove or restrict access to content;
• Suspend or terminate accounts.

All moderation decisions are final. You may contact us at hello@men-cave.ca for inquiries or appeals, but we are under no obligation to reverse decisions.

You may terminate your account at any time through your account settings.

We reserve the right to suspend or terminate your access to the Service at any time, without liability, for any reason, including violation of these Terms or conduct harmful to the community or business.

Upon termination:

• Your right to use the Service ceases immediately;
• Certain User Content may remain visible in anonymized form;
• We may retain data as required by law or for legitimate business purposes.

The Service is provided for informational and community purposes only.

Content available on MENCAVE does not constitute medical, legal, financial, or psychological advice.

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to:

• Merchantability,
• Fitness for a particular purpose,
• Non-infringement,
• Uninterrupted or error-free operation.

To the fullest extent permitted by applicable law, MENCAVE and its affiliates, officers, employees, and partners shall not be liable for any:

• Indirect, incidental, special, consequential, or punitive damages;
• Loss of profits, revenue, data, goodwill, or business opportunities;

arising out of or related to your use of, or inability to use, the Service, even if advised of the possibility of such damages.

You agree to defend, indemnify, and hold harmless MENCAVE and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use of the Service;
• Your violation of these Terms;
• Your User Content;
• Your violation of any third-party rights.

We may modify these Terms at any time. If changes are material, we will provide notice via the Service or by email.

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

These Terms are governed by the federal laws of Canada applicable therein, without regard to conflict-of-law principles.

You agree that any disputes shall be subject to the exclusive jurisdiction of the courts located in Montreal, Quebec, unless applicable consumer protection laws provide otherwise.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
